A report from the L.A. Times has shed light on a new agreement from Capital One, which says they can show up to your home or place of employment to collect on delinquent bills.  The new contract has outraged customers, who voiced their disapproval on Twitter.

The company says they can contact a cardholder however they see fit, and “may contact you in any manner we choose.” That means the company can contact a customer through a phone call, text message, email, or even with an in-person visit. According to the terms, a representative can technically show up on your doorstep.

In response, Capital One quickly reassured cardholders in an emailed statement: “Capital One does not visit our cardholders, nor do we send debt collectors to their homes or work.”

The new rules are the same as those sent to anyone who buys sports vehicles, such as jet skis or snowmobiles, through a secured loan from the bank. If those buyers don’t pay off their loans, Capital One may make “appropriate notification if it becomes necessary to repossess the vehicle.”

Daniel E. Kann, a lawyer who specializes in illegal-search cases, told the L.A. Times, “It sounds really invasive, but I don’t think it’s a violation of your 4th Amendment rights.”

Modifying caller ID?

Capital One also said they “may modify or suppress caller ID and similar services and identify ourselves on these services in any manner we choose.”

This means Capital One can call you from what appears to be a local number. Although this also sounds illegal, it is not. If you sign the terms of the agreement, you allow Capital One to make calls to you using a modified number.

David Lazarus, the L.A. Times columnist who wrote the story, asked a representative from Capital One about the company making screened calls to its customers. Pam Gerardo, a spokeswoman for the company responded, “Actually, we want our calls to display as Capital One on caller ID, and that’s the way they are programmed. However, some local phone exchanges may display our number differently. This is beyond our control, and we want out cardholders to be aware of that potential occurrence.”

Cardholders who pay their monthly credit card bill on time should not have to worry about a representative from Capital One showing up to their home or contacting them via text or phone call.
